Truly Insure LLC — SMS / Text Messaging Privacy Policy
1. Scope of This Policy
This SMS / Text Messaging Privacy Policy (“Messaging Policy”) describes how Truly Insure LLC (“Truly Insure,” “we,” “us,” or “our”) collects, uses, and shares information in connection with our SMS text messaging program (the “Program”). It applies specifically to your mobile phone number and any information you provide when you enroll in or receive text messages from us. It supplements, and does not replace, our general Privacy Policy, which governs our broader collection and use of personal information. Where this Messaging Policy and the main Privacy Policy conflict with respect to SMS messaging specifically, this Messaging Policy controls.
This Program is offered to residents of the United States and Canada. Section 10 below addresses additional disclosures for Canadian subscribers.
2. The Messaging Program
Truly Insure’s SMS Program sends transactional messages only related to services you have requested or an appointment, policy, or account you already hold with us. Message types include:
- Appointment confirmations, reminders, and rescheduling notices
- Service or callback scheduling updates
- Policy or account status notices directly related to a request you made
We do not send marketing or promotional text messages under this Program. If that changes in the future, we will update this Messaging Policy and obtain the appropriate additional consent before doing so.
3. Consent to Receive Messages
By providing your mobile phone number to Truly Insure through our website form and booking calendar, and by checking the applicable consent box or otherwise affirmatively opting in, you agree to receive transactional text messages from Truly Insure at that number regarding the services described in Section 2.
Consent to receive text messages is not a condition of purchasing any goods or services from Truly Insure, except where the text messages are the sole method by which a service you requested (such as an appointment reminder) is delivered.
Message and data rates may apply. Message frequency varies depending on your interactions with us; you can generally expect messages tied to your scheduled appointments.
4. How to Opt Out
You may opt out of receiving text messages from Truly Insure at any time by replying STOP to any message you receive from us. After you send STOP, we will send a one-time confirmation that you have been unsubscribed, and you will no longer receive text messages from this Program. You may also opt out by contacting us at privacy@trulyinsure.com.
If you opt out of transactional text messages, we may still need to contact you by phone, email, or mail regarding appointments or services you have requested, using the other contact information you have provided.

6. Supported Carriers
Carriers are not liable for delayed or undelivered messages. Supported carriers include major US and Canadian wireless carriers; coverage may vary and Truly Insure is not responsible for message delays or failures caused by your carrier or device.
7. Information We Collect
In connection with the Program, we collect and store:
- Your name
- Your mobile telephone number
- The exact consent language shown at opt-in
- Source/channel (web form URL, keyword reply, IVR path, etc.)
- The content and timestamps of messages exchanged with you
- Your consent opt-out/opt-in status and history
8. How We Use Mobile Information
We use the information described in Section 7 solely to:
- Deliver the transactional messages described in Section 2
- Confirm, manage, and honor your consent and opt-out preferences
- Provide customer support related to the Program
- Maintain records required for legal, regulatory, and carrier compliance purposes (e.g., TCPA/CASL consent records)
9. Sharing of Mobile Information
No mobile information, including consent or phone numbers collected for the purpose of SMS messaging, will be shared with any third party or affiliate for their own marketing or promotional purposes. Mobile opt-in data and consent will not be shared with any third parties for marketing or promotional purposes.
We may share the information described in Section 7 with:
- Our SMS/text messaging service provider, Twilio, Inc., solely to deliver messages on our behalf, subject to its own privacy and security obligations to us
- Vendors who perform services on our behalf (e.g., appointment scheduling, IT hosting), under contractual confidentiality obligations, and only as necessary to operate the Program
- Regulators, carriers, or law enforcement where required by law or to comply with legal process
- A successor entity in connection with a merger, acquisition, or sale of assets, subject to this Messaging Policy or a materially similar policy
We do not sell mobile phone numbers or consent records collected through this Program.
10. Canadian Subscribers
If you are located in Canada, the following additional terms apply. Transactional messages of the type described in Section 2 are generally exempt from Canada’s Anti-Spam Legislation (“CASL”) consent requirements because they relate to a service, appointment, or transaction you have already engaged; however, we still obtain your consent as described in Section 3 as a matter of policy. Your personal information collected through the Program is handled in accordance with the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and applicable provincial privacy legislation. You may withdraw consent (Section 4), and may request access to or correction of your personal information, by contacting us using the details in Section 12.
11. Data Security and Retention
We maintain reasonable administrative, technical, and physical safeguards designed to protect the information collected through the Program. We retain phone numbers, consent records, and message logs for as long as needed to operate the Program and to satisfy our legal, regulatory, and carrier record-keeping obligations, and in any case for at least 5 years per TCPA-related recordkeeping practice following your last interaction with the Program or your opt-out, whichever is later.

13. Changes to This Messaging Policy
We may update this Messaging Policy from time to time. The “Effective Date” at the top of this page reflects the date of the most recent revision. Material changes affecting how we use or share your mobile information will be communicated in accordance with applicable law.
