Truly Insure — SMS / Text Messaging Terms of Use
1. Acceptance of Terms
These SMS / Text Messaging Terms of Use (“Messaging Terms”) govern your enrollment in and use of the text messaging program (the “Program”) offered by Truly Insure LLC (“Truly Insure,” “we,” “us,” or “our”). By opting in to receive text messages from Truly Insure, you agree to these Messaging Terms and to our SMS Messaging Privacy Policy, which is incorporated into these Messaging Terms by reference.
These Messaging Terms supplement, and do not replace, our general Terms of Use. Where these Messaging Terms and the general Terms of Use conflict with respect to the Program specifically, these Messaging Terms control.
2. Description of the Program
The Program sends transactional text messages only, including appointment confirmations, reminders, and other service-related notices tied to a request, appointment, or account you already have with Truly Insure, as further described in our SMS Messaging Privacy Policy. The Program does not include marketing or promotional messages.
3. Eligibility
To participate in the Program, you must:
- Be the account holder, or have the account holder’s permission, for the mobile number you provide
- Be at least the age of majority for use of internet based applications in the jurisdiction in which you reside
- Reside in the United States or Canada
- Have a mobile device capable of sending and receiving SMS text messages on a supported carrier
4. Consent and Enrollment
You may enroll in the Program by providing your mobile number and affirmatively opting in through website form checkbox. By enrolling, you confirm that you are the owner or authorized user of the mobile number provided and that you are authorized to consent to receive messages at that number.
Consent to receive messages under the Program is not required as a condition of purchasing any goods or services, except where text message delivery is the sole method by which a service you requested is provided (for example, a text-only appointment confirmation you selected).
5. Message Frequency; Message and Data Rates
Message frequency will vary based on your interactions with Truly Insure (for example, the number of appointments you schedule). Message and data rates may apply based on your mobile carrier plan. Truly Insure is not responsible for any charges billed to you by your wireless carrier.
6. Opting Out and Help
You may cancel the Program at any time by texting STOP to the number from which you received messages. After texting STOP, you will receive a one-time confirmation message, and no further messages will be sent to you under the Program unless you re-enroll. 7. Carrier Non-Liability
Wireless carriers are not liable for delayed or undelivered messages. Truly Insure and its service providers are not liable for delays or failures in message delivery caused by your wireless carrier, your device, or factors outside our reasonable control.
8. Disclaimer of Warranties
THE PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, TRULY INSURE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND TIMELY DELIVERY OF MESSAGES. A TEXT MESSAGE REMINDER IS A CONVENIENCE AND DOES NOT REPLACE ANY OTHER CONFIRMATION OR NOTICE YOU MAY RECEIVE REGARDING YOUR APPOINTMENT OR ACCOUNT.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TRULY INSURE AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS (INCLUDING OUR SMS PLATFORM PROVIDER) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE PROGRAM, INCLUDING DAMAGES RESULTING FROM DELAYED, UNDELIVERED, OR MISDIRECTED MESSAGES. OUR TOTAL LIABILITY WILL BE LIMITED TO AN AMOUNT NO GREATER THAN ONE DOLLAR OR ANY AMOUNTS ACTUALLY PAID IN CASH BY YOU TO TRULY INSURE FOR THE PRIOR ONE MONTH PERIOD PRIOR TO THE FIRST EVENT OR OCCURRENCE GIVING RISE TO SUCH LIABILITY.
THE LIMITATIONS AND EXCLUSIONS ALSO APPLY IF THIS REMEDY DOES NOT FULLY COMPENSATE YOU FOR ANY LOSSES OR FAILS OF ITS ESSENTIAL PURPOSE.
10. Dispute Resolution; Governing Law
These Messaging Terms are governed by the dispute resolution, arbitration (if applicable), and governing law provisions of Truly Insure’s general Terms of Use, which are incorporated by reference and are governed by the substantive and procedural laws of Alberta, Canada without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of Canada. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Alberta, Canada, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
11. Privacy
Your use of the Program is also governed by our SMS Messaging Privacy Policy, which describes what information we collect through the Program and how we use and share it, including our commitment not to share your mobile information with third parties for marketing purposes.
12. Changes to These Messaging Terms
We may update these Messaging Terms from time to time. The “Effective Date” above reflects the date of the most recent revision. Continued participation in the Program after changes take effect constitutes acceptance of the updated Messaging Terms.
13. Termination
We may suspend or terminate the Program, or your participation in it, at any time, including if we believe you have violated these Messaging Terms or misused the Program.
